Modification to Case Valuation Matrix

Modifications to the Matrix were approved by the Trustees, with the consent of the Futures
Representatives and Trust Advisory Committee, as follows for claims submitted on or after June
1, 2026.

V. GRADE I NON-MALIGNANCY
(vii) Serious Asbestosis is

1. Asbestosis with ILO 2/2 or greater and AMA Class IV impairment.

Or

2. Where the Injured Person is “On Oxygen” and otherwise meets the requirements of subsections i, ii, or iii, below.

i. Injured Person has a diagnosis of asbestosis, has pulmonary function test results qualifying as Grade I, and a Pulmonologist or Occupational Medicine physician states that a contributing cause for the use of oxygen is asbestosis. Claim will be valued as a matrix claim even if there are other contributing causes listed for the need for oxygen.

ii. Injured Person has a diagnosis of asbestosis, but does not have pulmonary function test results qualifying as Grade I. Even though a Pulmonologist or Occupation Medicine physician states that the predominant cause or contributing cause for use of oxygen is asbestosis, claim a) will be valued under Individual Review and subject to the Individual Review process as described in Section VIII of the Matrix and b) if there are other contributing causes, the Trust will give equal weight to each cause for the need to be on oxygen.

iii. Injured Person has diagnosis of asbestosis, treating physician board certified in pulmonology or occupational medicine prescribes oxygen to the Injured Party, and the treating physician states the predominate need for oxygen is asbestosis. Regardless of the existence of other contributing causes for the need to be on oxygen, claim will be valued as a Matrix claim.

“On Oxygen” means oxygen needed to perform activities of daily life, e.g., not oxygen that is prescribed only for comfort care, at night, for surgery, or on occasion.

            Or

3.         “Asbestosis death” is

(i) when asbestosis is listed as the cause or a significant contributing cause of death on the death certificate.

or

(ii) Where a report from a Pulmonologist or Occupational Medicine Physician states that asbestosis was a significant contributing cause of death based on a finding that the Injured Person had Clinical Markers of  asbestosis within the treating records, and the Injured Person
meets the Matrix requirements of section I (b) and the diagnostic requirements of Grade I Non- Malignancy (V(a)(vii)(2)) or Enhanced Grade I Non-Malignancy (V(b)(vi)).

(a) “Clinical Markers ” of   asbestosis must be demonstrated by the presence of at least two of the following clinical markers: (1) severe pulmonary fibrosis (2) significant impairment of lung function, (3) showing of  progressive dyspnea (severe progressive shortness of breath), (4) bibasilar end-inspiratory rales (fine, dry “Velcro” crackles heard in the lower posterior lung base),   (5) respiratory failure (lungs unable to sufficiently exchange oxygen and carbon dioxide, leading to severe hypoxemia (low blood oxygen)), (6) signs of Cor Pulmonale (right-sided heart failure which can include pedal edema, jugular venous distension cyanosis, and hepatomegaly), and (7) chronic dry cough (a persistent nonproductive cough), ;

(b) If an Injured Person’s claim meets the requirements of paragraph (ii) above except for evidence of Clinical Markers of asbestosis within the treating records, the claim will be valued under the Individual Review process as described in Section VIII of the Matrix as well as subject to any other requirements in the Trust Distribution Procedures.

Or

(iii) Where a report from a Pathologist states that asbestosis was a significant contributing cause of death, supported by pathological/autopsy findings, including honeycombing or CAP-NIOSH pathological asbestosis Grade 3 or higher.

4.         If an Injured Person meets the requirements of “serious asbestosis” or “asbestosis death” above, then the valuation criteria for Lung Cancer, including the base Lung Cancer case, as defined in (III)(a), shall be utilized to determine the value of the claim, subject to any other requirements of the Trust Distribution Procedures. The Record review exception provision section I(c) applies to all disease categories within the Matrix, including serious asbestosis and asbestosis death claims.

Indexed Base Case Values for Economic and Medical Loss

Timing of Requests for Consideration at Trustees’ Meetings

Any requests for revisions to Trust policies or procedures, physician certification,
modifications to an approved list, and/or Trust Distribution Procedures/Matrix
interpretations or questions to be considered during the Trustees’ meeting must be received
by the Trust on or before the deadline, listed below.
